4Stems Terms of Service

1. Acceptance of Terms

By using the 4Stems service ("Service"), developed and owned by Picasso Interactive Limited ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, do not use the Service.

2. Description of Service

4Stems, a service provided by us, offers an online platform for separating audio tracks into individual stems (vocals, drums, bass, and other instruments) using AI technology.

3. Use of Service

  1. No user account is required to use the Service.
  2. You may upload songs, process them, and download the resulting stems without signing up.
  3. You are responsible for maintaining the confidentiality of your downloads and any transaction information.

4. User Content

  1. You retain all rights to the audio files you upload to the Service.
  2. By uploading content, you grant us a limited license to process your audio for stem separation.
  3. You represent and warrant that you have all necessary rights to the audio you upload.

5. Prohibited Uses

You agree not to:

  1. Use the Service for any illegal purpose.
  2. Upload content that infringes on others' intellectual property rights.
  3. Attempt to gain unauthorized access to the Service or its related systems.

6. Payment and Refunds

  1. The Service charges $2.99 per song processed, plus 5% VAT. Payment is taken upfront, after your file has been uploaded and checked and before it is processed.
  2. Payments are processed by Stripe and will appear as PICASSO.AE on your bank or credit card statement. By making a payment, you agree to Stripe's terms of service.
  3. If we are unable to process a song you have paid for, your payment is refunded automatically to your original payment method.
  4. Your stems are available to download for 48 hours after processing, after which they are permanently deleted. Please download them within this period; expired downloads are not eligible for a refund.
  5. Except as described above, payments are non-refundable unless required by law.

7. Intellectual Property

  1. We and our licensors retain all rights to the 4Stems Service and its technology.
  2. You may not copy, modify, or create derivative works of the Service.

8. Privacy and Data Usage

  1. When you pay, we keep a record of your order: your name and email address as provided at checkout, the payment reference, the name of the uploaded file and the amount paid. We use this only to deliver your stems, provide support, issue refunds and meet our accounting and legal obligations.
  2. Your card details are entered on and processed by Stripe. We never see or store them.
  3. Uploaded audio is stored securely and processed by our cloud storage and AI processing providers solely to perform stem separation. Your uploaded file is deleted once processing is complete, or within 24 hours if no payment is made. Your stems are deleted 48 hours after processing.
  4. We do not sell or share your personal data with third parties, except with the service providers needed to run the Service (such as Stripe for payments) or where required by law.
  5. We use Google Analytics to anonymously analyze traffic to the website. By using our Service, you consent to this anonymous data collection. For more information on how Google Analytics collects and processes data, please visit policies.google.com/technologies/partner-sites.

9. Disclaimer of Warranties

The Service is provided "as is" without any warranties, express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless our company, its affiliates, and 4Stems from any claims resulting from your use of the Service.

12. Modifications to the Service and Terms

  1. We reserve the right to modify or discontinue the 4Stems Service at any time.
  2. We may update these Terms at any time. Continued use of the Service constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of the United Arab Emirates, without regard to its conflict of law provisions.
